1. Introduction
Welcome to AI Humanizer API (“Service”), operated by AI Humanizer API (“Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website at aihumanizerapi.com and our API services. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. Definitions
API means Application Programming Interface, the programmatic interface through which you access the Service. API Key means the unique authentication credentials issued to you for accessing the API. Content means any text, data, or materials you submit to or receive from the Service. User or You means any individual or entity that accesses or uses the Service.
3. Account Registration
To access the API, you must create an account and obtain an API key. You agree to provide accurate, current, and complete registration information. You are responsible for maintaining the confidentiality of your API key and account credentials. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or API key.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to process content that violates any applicable law or regulation, infringes on intellectual property rights of third parties, contains malware, viruses, or harmful code, attempts to circumvent our security measures or rate limits, or is used for spamming, phishing, or fraudulent activities. We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these Terms.
5. API Usage and Rate Limits
Your use of the API is subject to the rate limits and usage quotas associated with your subscription plan. Exceeding these limits may result in throttling, temporary suspension, or additional charges as specified in your plan. We reserve the right to modify rate limits with reasonable notice. Current rate limits and quotas are detailed in our API Documentation and pricing pages.
6. Pricing and Payment
Certain features of the Service require a paid subscription. All fees are stated in US dollars and are non-refundable except as required by law. Subscriptions renew automatically unless cancelled before the renewal date. We reserve the right to change pricing with 30 days advance notice. Failure to pay may result in suspension or termination of your access to paid features.
7. Intellectual Property
You retain ownership of all Content you submit to the Service. By using the Service, you grant us a limited, non-exclusive license to process your Content solely for the purpose of providing the Service. We do not claim ownership of your input or output Content. The Service, including its software, algorithms, documentation, branding, and design, is owned by the Company and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
8. Data Processing and Privacy
We process your Content only to provide the Service and do not store processed text beyond the duration needed to complete your request. Our data handling practices are described in our Privacy Policy, which forms part of these Terms. For enterprise customers, we offer Data Processing Agreements (DPAs) upon request. We implement industry-standard security measures including TLS 1.3 encryption, SOC 2 Type II compliance, and GDPR-compliant data handling.
9. Service Availability and SLA
We strive to maintain 99.99% uptime for the API. However, the Service is provided “as is” without guarantees of uninterrupted availability. Scheduled maintenance windows will be communicated in advance. Enterprise customers with SLA agreements are subject to the terms specified in their individual contracts. We are not liable for downtime caused by factors beyond our reasonable control, including internet outages, force majeure events, or third-party service failures.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that the results obtained from the Service will be accurate or reliable.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your access to the Service immediately if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email at least 30 days before they take effect. Your continued use of the Service after modified Terms become effective constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.
